Welcome to Toddlers CAN Read. These Terms of Service ("Terms") govern your use of the toddlersread.com website, our products, courses, quizzes, communities, coaching programs, emails, and related services (collectively, the "Services"), all of which are owned and operated by Toddlers CAN Read LLC ("Toddlers CAN Read," "TCR," "we," "our," or "us").
By using our Services, creating an account, or purchasing from us, you agree to these Terms. If you do not agree, please do not use the Services.
These Terms include an arbitration agreement and class action waiver in the "Dispute Resolution" section below, which affect your legal rights. Please read carefully.
1. Who Can Use the Services
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or make a purchase. By using the Services, you confirm you meet this requirement and that you are financially responsible for all activity under your account, including activity by anyone you allow to use your login credentials.
Our Services are designed for adults — parents, caregivers, and educators teaching children to read. Children may use our materials with adult supervision and through an adult's account, but the account holder is the parent or caregiver.
2. Your Account
When you create an account, you agree to:
- Provide accurate, current information
- Keep your login credentials confidential
- Not share your account, login, or course access with anyone else
- Notify us promptly at support@toddlersread.com if you suspect unauthorized use
You are responsible for everything that happens under your account.
3. Orders and Payment
Placing an Order
When you place an order, you agree to pay the full amount listed at checkout, including any applicable taxes and shipping. Prices are subject to change without notice, but changes won't affect orders already placed.
Errors and Inaccuracies
We work to keep product descriptions, pricing, availability, and other content on the Services accurate and current, but we do not guarantee that everything is complete or error-free. We reserve the right to correct errors, update information, and cancel or refuse orders affected by a pricing or product error, including after an order has been submitted.
Payment Processing
Payments are processed by our third-party payment providers (Shopify Payments, Shop Pay, and PayPal). By placing an order, you authorize the charge to your chosen payment method.
Physical Products
If your order includes physical products, you'll receive an estimated delivery timeframe at checkout. Delivery dates are estimates and may be affected by carrier delays, weather, or other conditions outside our control.
Digital Products and Course Access
When you purchase a course or digital product, we grant you a limited, personal, non-transferable, non-exclusive, revocable license to access and use the materials for your own household's use. You may not:
- Share your login or account access with anyone outside your household
- Download, copy, redistribute, resell, or publish course content
- Use our materials to teach paid classes or build a derivative product
- Remove or alter copyright, trademark, or other proprietary notices
We reserve the right to suspend or terminate access to digital products if these Terms are violated.
4. Refunds and Cancellations
Digital Courses
We offer a full refund on digital course purchases within 30 days of purchase. To request a refund, email support@toddlersread.com.
If your course purchase included free or promotional physical products (for example, a free flashcard set with course purchase), the retail value of those physical products and any shipping costs we incurred will be deducted from your refund.
Physical Products
We offer a 30-day refund on physical products purchased directly from toddlersread.com. To request a refund, email support@toddlersread.com. Items must be returned in the same condition you received them, including original packaging. Items may be opened. Once we receive and inspect the return, we'll notify you whether the refund is approved. Approved refunds are issued to the original payment method.
Return shipping costs are the customer's responsibility unless the return is due to our error (wrong item shipped, defective product, etc.).
Coaching Cohort
Our coaching cohort is a month-to-month program at $999/month. By enrolling, you authorize Toddlers CAN Read LLC (and our payment processor) to charge your payment method $999 each month until you cancel. You can cancel future payments at any time by emailing support@toddlersread.com. Cancellations stop future billing and end access at the conclusion of the current billing cycle. Past payments are not refunded.
Coaching, community access, and educational guidance provided through our Services are intended to support early literacy development and parental confidence. They do not constitute therapy, medical advice, educational diagnosis, special education services, or professional counseling. If you have concerns about a child's development, hearing, vision, speech, or learning, please consult a qualified professional.
Bundles
If you purchased a bundle and request a refund, the refund will be calculated based on the bundle price actually paid, not the individual retail prices of the items.
5. Free Resources, Quizzes, and Workshops
We offer free resources, quizzes, downloads, webinars, and workshops. By signing up, you may receive related emails and follow-up communications. You can unsubscribe from marketing emails at any time using the unsubscribe link.
Free resources are provided as-is, may change or be discontinued at any time, and don't create any ongoing obligation on our part.
6. Intellectual Property
Our Content
All content on our Services — including course videos, written materials, flashcards, decodable books, illustrations, photography, logos, the "Toddlers CAN Read" name and branding, the "Stage, not Age" tagline, software, and the look and feel of the Site — is owned by Toddlers CAN Read LLC or our licensors and is protected by U.S. and international intellectual property laws.
Except for the limited license granted in Section 3, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publish, sell, license, or otherwise exploit any of our content without our prior written permission.
Your Submissions
If you send us testimonials, photos, videos, reviews, comments, or other content ("Submissions"), you grant Toddlers CAN Read LLC a worldwide, royalty-free, perpetual, irrevocable, sublicensable, transferable license to use, reproduce, modify, adapt, publish, display, and distribute that content in connection with our Services and our marketing.
You represent that:
- You own or have the right to share what you send us
- Your Submissions don't violate anyone else's rights
- If your Submission includes images or videos of children, you are the parent or legal guardian and you consent to our use of the content
If you'd like us to stop using a Submission you previously sent, email support@toddlersread.com and we'll remove it from materials we control going forward.
Testimonials and customer examples reflect individual experiences and are not guarantees of similar results for your child or family.
7. DMCA and Copyright Concerns
If you believe content on our Services infringes your copyright, send a written notice to support@toddlersread.com with:
- A description of the copyrighted work you claim has been infringed
- The URL or location of the allegedly infringing content
- Your contact information
- A statement that you have a good-faith belief the use is not authorized
- A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on the owner's behalf
- Your physical or electronic signature
We will respond as required by the Digital Millennium Copyright Act.
8. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Services
- Interfere with the security or operation of the Services
- Scrape, harvest, or mine data from the Services
- Use the Services to harass, abuse, or harm others
- Contact, advertise to, solicit, or sell to our users without their express consent
- Use any automated system (bots, scrapers, etc.) to access the Services
- Impersonate anyone or misrepresent your affiliation with any person or entity
We reserve the right to terminate access to anyone who violates these rules.
9. Third-Party Services and Links
Our Services may link to or integrate with third-party websites and services (for example, our course platform is hosted on Kajabi; payments are processed through Shopify and PayPal). We are not responsible for the content, practices, or policies of those third parties. Your use of any third-party service is governed by that service's own terms and policies.
10. Affiliate Program
We operate an affiliate program. Participation requires acceptance of separate Affiliate Program Terms, which govern commission structure, promotional practices, and termination. Nothing in these Terms creates an affiliate relationship by itself.
11. Disclaimers
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, TODDLERS CAN READ LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
Educational Outcomes. Our materials are designed to support early literacy development, but every child learns differently. We do not guarantee any specific educational outcome, timeline, or result from use of our Services.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TODDLERS CAN READ LLC AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
We are not responsible for delays or failures caused by events outside our reasonable control, including acts of God, weather, war, civil unrest, pandemics, government actions, internet or carrier failures, or shipping carrier delays.
Some jurisdictions don't allow limitations on certain warranties or damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Toddlers CAN Read LLC, its officers, employees, agents, and affiliates from any claim, loss, liability, demand, or expense (including reasonable attorneys' fees) arising from your use of the Services, your Submissions, or your violation of these Terms.
14. Dispute Resolution and Arbitration
Please read this section carefully — it affects your legal rights.
Informal Resolution First
If you have a dispute with us, please email support@toddlersread.com first. Most issues can be resolved quickly. You agree to attempt to resolve disputes informally for at least 30 days before starting arbitration.
Binding Arbitration
If we can't resolve the dispute informally, you and Toddlers CAN Read LLC agree to resolve any disputes arising out of or relating to these Terms or the Services through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be held in Houston, Harris County, Texas, or by video/phone at your election, before a single arbitrator. The Federal Arbitration Act governs this section.
Class Action Waiver
You and Toddlers CAN Read LLC agree that disputes will be resolved only on an individual basis, and not as a class action, collective action, or representative action. The arbitrator may not consolidate claims or preside over any form of class or representative proceeding.
Exceptions
Either party may bring an individual claim in small claims court if it qualifies. Either party may also seek injunctive relief in court to protect intellectual property rights.
Opt-Out
You may opt out of this arbitration agreement by emailing support@toddlersread.com with "Arbitration Opt-Out" in the subject line within 30 days of first accepting these Terms. Opting out won't affect any other provision of these Terms.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Texas and the United States, without regard to conflict-of-laws principles. Any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top. If the changes are material, we'll let you know by email or through a notice on the Site. Your continued use of the Services after changes take effect means you accept the revised Terms.
17. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or if we discontinue any Service. You may stop using the Services at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
18. General
Entire Agreement. These Terms, together with our Privacy Policy and any other terms referenced here, constitute the entire agreement between you and Toddlers CAN Read LLC regarding the Services.
Severability. If any part of these Terms is found unenforceable, the rest will remain in effect, and the unenforceable part will be modified to the minimum extent needed to make it enforceable.
No Waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
No Assignment by You. You may not assign or transfer these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
No Agency. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Toddlers CAN Read LLC.
Headings. Section headings are for convenience only and don't affect interpretation.
